These General Conditions of Use and Sale (hereinafter “ General Terms and Conditions ") are intended to define the terms and conditions applicable to the online sales offered on the website www.actionsport.be and the use of this site published by the non-profit association ACTION SPORT, registered with the BCE under number 0451.260.925, whose headquarters are located at Rue Bryun, 105 1120 Brussels (hereinafter “ Action Sport »).

For the purposes hereof, the terms and expressions identified by a capital letter have the meaning indicated.

• MyAction Sport Account: designates the personal space that the Client must create on the Site, as described in article 6 below.
• Internship: Any type of sports or creative internship organized and supervised by Action Sport for children aged 3 to 16, including the following internships: swimming, cycling, rollerblading, fun sports, chef coq, football, tennis, athletics, hockey, judo, diving, mountain biking, horse riding, multisports, dance, science, music, jewelry, theater, firefighter, photography, etc.
• Registration: means the online registration of a Client or the child under their responsibility via the Site. Registration is validated by receipt of the confirmation email. Registration covers the entire duration of the Course. Unless otherwise stated, the duration of the Course is one full week except in the case of public holidays (except All Saints' Day and Christmas where registrations for two days may be offered).
• Client: Any natural or legal person who has completed and sent a registration request for a Course and has accepted these general conditions without reservation.
• Site: means the website accessible from the address www.actionsport.be or any other URL that Action Sport may substitute for it.
• User: means any person who uses the Site, whether or not they are a Customer.
Since 1993, Action Sport has been offering a multitude of activities throughout Wallonia and Brussels to enable the discovery of the pleasures of water, of practicing a sporting activity in a friendly atmosphere and through quality training in a professional framework. Action Sport aims to promote different values such as respect, autonomy, conviviality and sociability. Action Sport is a non-profit organization recognized and approved by the ONE.
3.1. The purpose of these T&Cs is to (i) define the conditions under which Users can access the Site and register for Courses, (ii) manage the relationships between Users, Customers and Action Sport.
3.2. The T&Cs apply to Users of the Site, whether they are Customers or not. Expressing specific and essential clauses for Action Sport, the T&Cs prevail over all other general conditions, which the Customer accepts.
3.3. Customers who register on the Site are natural persons of legal age and legal capacity or represented. Customers may also be duly represented legal entities.
The Client declares and guarantees that he has the legal capacity as well as the rights, powers, titles, authorizations necessary to register on the Site and contract with Action Sport under this contract.
4.1. The User agrees to comply with the General Terms and Conditions, without restriction or reservation, whether consulting the Site or registering for a Course. The General Terms and Conditions are notified to Users for acceptance prior to any registration.
For Users who are not registered on the Site, the T&Cs are applicable for any consultation or navigation on the Site.
The User must consult these General Terms and Conditions before using the Site and undertakes to consult them regularly at the address www.actionsport.be
Browsing the Site constitutes acceptance of the T&Cs by the User.
4.2. Action Sport reserves the right to modify the T&Cs at any time and without notice, in particular to take into account legal, jurisprudential and technical developments.
Action Sport will inform the Customer by any means.
In the event of a modification, the General Terms and Conditions applicable to the Client are those in effect on the date of Registration. Each new registration requires acceptance of the General Terms and Conditions by the Client, which the Client acknowledges and accepts.
4.3. Acceptance of these T&Cs implies acceptance of the “COVID-19 Charter” available at the address www.actionsport.be and communicated by email to the Client before the first day of the Internship.
In accordance with the requirements of Book VI of the Code of Economic Law, Action Sport presents on the Site a detailed description of the Courses offered and the corresponding prices so that the Client can, before registering, know the essential characteristics of the Courses (description of the activities, location of the Course and times, available options such as the organization of a daycare and the price thereof, etc.). The Client declares to have read and to have obtained from Action Sport, prior to his Registration, all the information on the Courses and their content. He declares to be solely responsible for the choice of the Course as well as its suitability to his needs.
6.1. Registration requires the Client to click on the “Internship” button on the home page of the Site www.actionsport.be
The Client is redirected to a page where they are invited to select the desired location of the Internship (according to the province) and then the desired municipality. On a new page, the Client sees a table that lists the available Internships and the period in which they are organized. They click on one of the green "V" buttons that indicates the remaining places at each of the Internships and are then redirected to a page indicating the price of the Internship and offering a summary of the essential characteristics of the Internship.
If desired, the Client is invited to click on the "CONTINUE" button and select the "groups" of activities that make up the Course. For example, registering for the "Multi-sport Tennis" Course involves selecting the "tennis" and "multi-sport" groups.
Then, if the Customer already has a MyAction Sport Account, they will simply need to log in. If this is not the case, the Customer will need to create an account, by filling out the required fields in the form provided for this purpose.
The identification details and data entered in the MyAction Sport Account are strictly personal and confidential. The Customer undertakes to keep their identification details secret and not to disclose them, for any reason whatsoever, in any manner or in any form whatsoever, to third parties. If their identification details are lost or stolen, the Customer must immediately inform Action Sport by email at the following address: [email protected] who will then proceed to the immediate cancellation and/or update(s) of the elements of the MyAction Sport Account.
Under no circumstances shall Action Sport be held liable for the loss or theft of the MyAction Sport Account identification details or their fraudulent use. The Customer is solely responsible for the use of their MyAction Sport Account and for any actions or statements made through it, whether fraudulent or not. The Customer shall indemnify Action Sport against any claim in this regard that is caused by fault or negligence on their part.
Once the MyAction Sport Account has been created or the Customer has logged into the MyAction Sport Account, they click on the "Continue your registration" button and are taken to a page offering to purchase a membership card (which provides access to discounts). The Customer is also invited to fill in, if necessary, the fields indicated in the provided form (child's school, promotional code, etc.).
The Client is invited to check the summary and the total price, as well as the Courses listed. He is also invited to read the General Terms and Conditions and tick the box to accept them.
He must also check the box “Covid-19: “I declare on my honor that my child does not present a risk of comorbidity linked to Covid-19” as long as it is displayed.
The Customer can then validate their registration and proceed to payment by bank transfer.
An email acknowledging receipt of the Registration will be sent to the Customer at the address provided when creating their MyAction Sport Account as soon as possible. This acknowledgment of receipt will include the Registration number and price, these General Terms and Conditions or a link to them. If the Customer has chosen to pay by bank transfer, the Registration confirmation email will also indicate the structured communication to be provided at the time of payment.
6.2. Any modification to the Registration after confirmation thereof is subject to acceptance by Action Sport.
6.3. Action Sport specifies that a registration made orally and not confirmed in writing will not be considered. Registration is therefore finalized on the date of receipt of the confirmation email. The User or Client has read and accepts these terms and conditions.
6.4. Action Sport generally closes registrations on the Thursday of the week preceding the Course, at 9 a.m. For any last-minute registration, a supplement of 15 euros will be charged to the Client's account, which the Client accepts.
6.5. Action Sport reserves the right to change the group or activity of a child who is not the required age to participate in the course or who is not suitable for the activity. Any difference in age from the age indicated on the website is subject to acceptance by Action Sport.
7.1. Prices displayed on the Site are quoted in euros, inclusive of all taxes. These prices include the VAT applicable on the day of Registration. The total amount due is indicated on the Registration confirmation page.
Prices include supervision of children, insurance (the risk of damage to glasses, clothing, jewelry, watches, etc. is not covered), equipment, premises and any transport depending on the activity chosen.
7.2. If registration is made within five working days prior to the start of the Course, proof of payment may be requested upon the participant's arrival.
7.3. In the event of non-payment on time, a free reminder email will be sent to you. In the event of persistent non-payment, the file will be forwarded to the VENTURIS collection agency. The latter will then take over and automatically apply a fixed penalty of 20 euros as well as late payment interest at the key rate increased by 8 points until full payment. A similar penalty may be charged, as a reciprocal measure, in the event of failure to meet our obligations.
8.1. Action Sport cannot be held liable, generally speaking, in any case where the non-performance or poor performance of its obligations results from a case of force majeure or fortuitous event beyond its control.
8.2. The User acknowledges that their use of the Site is at their own risk. The Site is provided to them "as is". Action Sport will make its best efforts to make the Site accessible 24 hours a day, seven days a week, except in the event of an event beyond the control of Action Sport and subject to maintenance periods, possible breakdowns, technical hazards linked to the nature of the network or malicious acts or any damage to the hardware or software of Action Sport.
Action Sport cannot be held liable under any circumstances for any interruption of all or part of the Site, regardless of the cause, duration or frequency of this interruption, provided that this interruption is not attributable to it.
8.3. Action Sport is not bound by any obligation of results and cannot be held responsible for omissions, inaccuracies or errors in the programs included on its site, nor for the consequences that these could have for Customers.
8.4. Action Sport cannot be held liable under any circumstances in the event of an error, omission or inaccuracy mentioned during the Courses or in the documents provided to Clients as part of these.
8.5. Action Sport does not guarantee that the Courses offered correspond to the needs of the Client, who is solely responsible for his choice.
8.6. Action Sport is not responsible for loss, theft or breakage of items brought to the Course by participants.
8.7. If Action Sport's liability is established, it will be limited to an amount equal to the price of the Course without any compensation for other indirect damages of a financial, commercial or other nature, such as loss of earnings, loss of reputation, savings or expected customers.
9.1. Action Sport grants the Client a period of 14 (fourteen) calendar days to withdraw from the Registration, without having to provide a reason for their decision, starting from the day of Registration. After this period, no withdrawal request will be processed by Action Sport, subject to what is provided for in Article 9.2.
The Customer who exercises his right of withdrawal must complete the withdrawal form annexed to Book VI of the Code of Economic Law, available at the URL

He may also inform Action Sport of his decision to withdraw by sending an unambiguous declaration expressing his wish to withdraw by email to the address [email protected]
In the event of exercising the right of withdrawal, Action Sport will reimburse the Customer for all sums paid, if applicable, without undue delay and at the latest within 14 (fourteen) calendar days from the date on which it is informed of the Customer's wish to withdraw.
The refund will be made by crediting the amount debited to the account corresponding to the Customer's bank card.
9.2. After the 14 (fourteen) calendar day period for exercising the right of withdrawal, Action Sport gives the Client the option to cancel the registration free of charge, provided that the cancellation request has been sent in writing to Action Sport no later than 10 (ten) days before the start of the training courses. In this case, Action Sport will reimburse the Client for the sums paid, without any deduction of fees.
In the event of withdrawal more than 14 (fourteen) calendar days from the date of registration but occurring less than 10 (ten) calendar days before the start of the course, Action Sport will reimburse the Client for the sums paid less the sum of 15 euros, retained in payment of the administrative costs borne by Action Sport, which the Client accepts.
9.3. In the event of withdrawal on the 1st day of the Course or during the Course, the price of the entire Course is due to Action Sport except in the event of prolonged illness as provided for in article 9.4.
9.4. In the event of prolonged illness of the child for at least three consecutive days, the Client may obtain reimbursement for the days of the Course in which the child was unable to participate less the sum of 30 euros, retained as payment of the administrative costs incurred by Action Sport, upon production of a medical certificate within one week from the first day of absence.
In the event of exercising the right of cancellation, Action Sport will reimburse the Client for the sums due where applicable, without undue delay and at the latest within 14 (fourteen) calendar days from the date of the last day of absence.
10.1. The lack of sufficient registrations for a Course as well as the impediment of an instructor, constitutes for Action Sport cases of force majeure which allow Action Sport to change instructor without obligation to inform the Client in advance or to set a new date for the Course without having to demonstrate the unpredictability and unforeseeability of the circumstances or the impossibility for Action Sport to fulfill its obligations. These events being external to Action Sport, it cannot be held responsible.
10.2. In the event of cancellation of a Course, the Client will have the option to opt for another Course at the same time, subject to availability. If no alternative Course proposal is suitable for the Client, the Client will be fully reimbursed for any amounts already paid to Action Sport.
10.3. In the event of a change in the dates of a Course, the Client has the right to cancel their registration and obtain a refund provided that this request is brought to the attention of Action Sport in writing within 14 working days following the date on which the change of date was notified to the Client.
If the Client does not respond within this period, their registration will be considered confirmed for the new dates.
10.4. Without prejudice to the special regimes to be adopted by the competent authorities, the threat of the Covid-19 virus and the taking of measures against it as well as the threat of other epidemics and the taking of measures against them, as well as all acts of government, strikes, lockouts, riots, mobilization, bad weather, shortages of equipment or means of transport, fires, etc., are automatically considered, for the purposes hereof, as constituting a case of force majeure justifying the cancellation of a Course without Action Sport having to demonstrate the unforeseeability, the irresistibility of the circumstances and the impossibility of fulfilling its obligations. The same applies to the cancellation of the Course due to usual symptoms of the Covid-19 virus detected in the participant or another participant within the same "bubble". These events being external to Action Sport, it cannot be held responsible. These cases of force majeure do not exempt the Client from paying all or part of the Registration price.
11.1. Action Sport and the Client reserve the right to terminate the contractual relationship at any time in the event of non-compliance by the other party with any of its obligations under these T&Cs, without prejudice to any possible damages that may be claimed from the defaulting party.
11.2. The termination of contractual relations in the event of fault on the part of the Client results in the immediate payment of the remaining amounts due.
11.3. Action Sport reserves the right to terminate the Course of a child whose behavior constitutes an obstacle to the smooth running of the Course of other children.
12.1. The Client must provide their child's lunch as well as sufficient snacks and drinks.
12.2. In the event of inclement weather, planned outdoor activities will continue. The Client must provide appropriate clothing for their child as well as a change of clothes. As a general rule, they must provide clothing appropriate for the activities of the Course.
12.3. If a Course requires travel (swimming, horse riding, tennis, etc.), this will be organized by Action Sport using vehicles such as minibuses, vans, cars or public transport.
12.4. Signed authorization from the parent(s) is required if the child returns alone or with a third party at the end of the course.
12.5 Childcare is available on the days of the course. Hours and rates vary depending on the center selected.
If the Customer arrives after 6 p.m., a supplement of 10 euros per quarter of an hour started will be charged to the Customer's account, which the Customer accepts.
13.1. The User undertakes to comply with the laws in force when using the Site and in particular not to make discriminatory, racist, xenophobic, anti-Semitic remarks, nor insults, abuse or other violent or pornographic remarks, nor to publish content contrary to public order or morality.
The User is also prohibited from using the Site for promotional purposes.
The User undertakes not to attempt to harm the operation of the Site or Action Sport.
13.2. Action Sport cannot be held responsible for any incompatibility, malfunction or other technical problems between the use of the Site and the User's computer equipment, except in the event of a fault attributable to Action Sport.
The User must protect his computer equipment against any risk of contamination by viruses, attempted intrusion, etc.
13.3. When creating their MyAction Sport Account online on the Site, the User undertakes to provide true, accurate, up-to-date and complete information about their identity.
14.1. The Site, all elements found on the Site and the documents provided to Clients as part of the Courses are protected by intellectual property rights (including in particular all copyright, rights to patents, trademarks, designs and models, databases, domain names and any other existing or future intellectual property rights, Belgian and international) and belong to Action Sport or to third parties having authorized it to use them.
The use of the Site or the documents provided to Clients as part of the Courses does not confer any intellectual property rights on the Client.
14.2. Any reproduction or representation, in whole or in part, of the Action Sport website or of the documents provided to Clients as part of the Courses without the prior written consent of Action Sport constitutes a violation of the intellectual property rights of the latter and/or of third-party grantors and may result in civil and criminal proceedings.
15.1. Action Sport ensures respect for customer privacy and data. It undertakes to ensure that the information collected is processed in accordance with applicable laws and regulations.
When using the Site, Users may be required to provide a certain amount of personal data about themselves (surname, first name, telephone number, email address, etc.).
The personal data provided is particularly necessary for access to registration forms, their validation and payment, for the management and monitoring of registrations by Action Sport and to respond to Customer requests as well as to facilitate their identification and navigation on the site and for statistical purposes. The data may also be used to carry out operations relating to prospecting.
Access to personal data is strictly limited to Action Sport staff, authorized to process it due to their duties.
The Client is informed that in the event of a legal or judicial obligation requiring it to do so, Action Sport may be required to transmit its personal data.
The data collected when registering for a Course is kept until its deletion, which is left to the initiative of the Client unless:
In accordance with applicable legal and regulatory provisions, the Client has the right to access, rectify, transfer, and erase their data, as well as to limit processing. They may also, for legitimate reasons, object to the processing of their data.
He may therefore require that any personal data concerning him that is inaccurate, incomplete, ambiguous or outdated be rectified, completed, clarified, updated or deleted. The Client's personal data is also deleted when the Client expressly withdraws his consent to the collection and processing of his personal data, subject to Action Sport's legal obligations. The Client may
also, under the right to the portability of his personal data, retrieve those concerning him for his personal use, or request that they be transferred to a third party, if this is technically feasible. Each Client may also oppose, for legitimate reasons, the processing of data concerning him, and request the limitation of the processing of data.
To exercise these rights, the Customer must send a written request to Action Sport stating their first and last name. Action Sport may ask the Customer to prove their identity by attaching any necessary document to their request, including a copy of their identity card or passport.
Customers also have a right to lodge a complaint, which they can exercise with the national supervisory authority, namely the Data Protection Authority.
Action Sport will implement the means at its disposal to process requests relating to Customers' personal data as quickly as possible.
In the event of a security breach or loss of personal data relating to Customers, Action Sport will inform them by email in accordance with applicable legal conditions. It will take all necessary measures, within the limits of its human, material, and financial resources, to remedy the breach and ensure data security.
15.2. Data may also be collected through cookies.
In fact, during each of the User's visits to the Site, Action Sport collects information relating to its connection and navigation.
Cookies are an automatic tracking process that records information relating to browsing on the Site, and stores information entered during visits to the Site in order to facilitate the registration process and use of the Site.
The User may oppose their implementation and/or delete them following the procedure indicated on their browser.
A cookie has a limited validity period of thirteen (13) months maximum. Its deposit and storage on the terminal of the User are made in compliance with applicable laws and regulations and subject to the choices expressed by the User, which he can modify at any time.
Cookies have several functions, such as facilitating the use of the Site, remembering the User's choices, goods and services that he wishes to purchase, offer the User relevant advertising content.
Action Sport collects the User's express consent regarding the use of cookies.
The cookies placed by Action Sport give it access to information enabling it to establish User browsing statistics.
Photos taken during the Course are considered free for use by Action Sport for its communication tools: websites, social networks, etc.
The use of these images is for no other purpose than to illustrate Action Sport's projects and activities. However, the Client has the opportunity to object to this use.
Action Sport invites the Client who has made this choice to inform the instructors, from the first day of the Course, so that the photos of his child are not published on any media.
17.1. No modification of these T&Cs may be made unless it is negotiated, authorized and signed by a duly authorized representative of Action Sport and unless this modification contains the express mention that it consists of an adaptation of these T&Cs.
17.2. If one or more provisions of these General Terms and Conditions are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope. Action Sport and the Client shall, however, undertake to negotiate and conclude one or more provisions intended to cover the nullity found.
17.3. The fact that one of the Parties does not assert against the other Party a breach of any of the obligations referred to in the General Terms and Conditions of Sale cannot be interpreted in the future as a waiver of the obligation in question or a waiver of asserting this failure or breach.
17.4. The fact that one of the Parties does not avail itself of a stipulation of these General Terms and Conditions of Sale does not in any way constitute a waiver of the benefit of said stipulation.
18.1. The rights and obligations resulting from these General Terms and Conditions are exclusively subject to Belgian law.
18.2In the event of a dispute relating to a registration, the Client must contact Action Sport as a priority, in order to find an amicable solution.
In the absence of an amicable solution and whatever the origin of the conflict, disputes relating to the execution or interpretation of these General Terms and Conditions will be submitted to the courts of the judicial district of Brussels or to the competent Court in accordance with Article 624, 1°, 2° and 4° of the Judicial Code if the Client is a consumer within the meaning of the Code of Economic Law.
For all practical purposes, it is specified that the time limits for taking legal action are not interrupted during the period in which an amicable solution is sought or mediation is requested.

In accordance with the requirements of Book VI of the Code of Economic Law, Actionsport presents on the Site a detailed description of the Extracurricular Activities offered and the corresponding prices so that the Client can, before registering, know the essential characteristics of the Extracurricular Activities (description of the activities, location of the Extracurricular Activities (description of the Courses, locations, ages, times and costs of the Membership, etc.). The Client declares to have read and to have obtained from Actionsport, prior to his Registration, all the information on the Extracurricular Activities and their content. He declares to be solely responsible for the choice of the Extracurricular Activity as well as its suitability to his needs.
6.1. Registration requires the Client to click on the “Courses” button on the Site’s home page www.actionsport.be.
The Client is redirected to a page listing the various Extracurricular Activities offered with a "more info" link that the Client is invited to click. After a description of the content of the Courses provided, the locations, ages, times and the cost of the Membership Fee for the selected Extracurricular Activity are listed.
The Client is invited to select the “REGISTER” button.
On the new page, the Client sees a table listing the geographical locations available for the selected Extracurricular Activity and its cost per location. The Client is invited to select the chosen location and click on it. They are then redirected to a page entitled "NEW REGISTRATION" providing a summary of the essential characteristics of the selected Extracurricular Activity, including the location of the location, the period during which the activity will take place, and the location of the location.
which the extracurricular activity is provided, the price of the subscription and a description of the content of the courses.
If the Client wishes, they are invited to click on the "CONTINUE" button and select a group from the group(s) entered in which a green smiley appears, indicating that there are still places available for the group(s) entered.
For example, the Client will have to check the group of the course he selects “1st to 6th primary Acrogym: Monday 4:20 p.m. – 5:20 p.m. – Baisy-thy”.
Then, if the Client already has a MyActionsport Account, they will simply need to log in. If this is not the case, the Client will need to create an account, by filling out the required fields in the form provided for this purpose.
The identification details and data entered in the MyActionsport Account are strictly personal and confidential. The Customer undertakes to keep their identification details secret and not to disclose them, for any reason whatsoever, in any manner or in any form whatsoever, to third parties. If their identification details are lost or stolen, the Customer must immediately inform Actionsport by email at the following address: [email protected] who will then proceed to the immediate cancellation and/or update(s) of the elements of the MyActionsport Account.
Under no circumstances shall Actionsport be held liable for the loss or theft of MyActionsport Account identification details or their fraudulent use. The Customer is solely responsible for the use of their MyActionsport Account and for any actions or statements made through it, whether fraudulent or not. The Customer shall indemnify Actionsport against any claim in this regard that is caused by fault or negligence on their part.
Once the MyActionsport Account has been created or the Customer has logged into the MyActionsport Account, they click on the "Continue your registration" button. The Customer is also invited to fill in the fields indicated in the provided form (child's school, promotional code, etc.) if necessary.
The Client is invited to select the person to register or to register a new member if applicable.
On a new page, the Client is invited to check the summary concerning the participant, the price and the options, as well as the possibility of completing under a “comment” point, a possible “general” and/or “medical” remark.
At the bottom of the page, the customer is also invited to read the T&Cs and check the box to accept them, before confirming the participant's registration. There is also
the possibility of reading Actionsport's data usage policy by clicking on the link "policy for using your data".
He must also check the box “Covid-19: “I declare on my honor that my child does not present a risk of comorbidity linked to Covid-19” as long as it is displayed.
An email acknowledging receipt of the Registration will be sent to the Client at the address indicated when creating their MyActionsport Account as soon as possible. This acknowledgment of receipt will include the dates and times of the Courses, the location, the equipment that the participant must bring, the cost of the Membership Fee, the payment deadline, the payment details including the structured communication to be indicated at the time of payment. It will also include information in the event of absence, in the event of cancellation, information relating to a reimbursement from the mutual insurance company and the tax certificate that Actionsport issues via the MyActionsport Account, as well as a link to these General Terms and Conditions.
6.2. Any modification to the Registration after confirmation thereof is subject to acceptance by Actionsport.
6.3. Actionsport specifies that a registration made orally and not confirmed in writing will not be considered. Registration is therefore finalized on the date the confirmation email is received. The User or Client has read and accepts these terms and conditions.
6.4. If the participant no longer wishes to continue the Courses after a Course, the Client shall inform Actionsport. In this case, the Course in question will be considered as a Trial.
6.5. The Client may register for an extracurricular activity during the school year, subject to places still being available for this activity.
6.6. Actionsport reserves the right to modify or delete an extracurricular activity in the event of insufficient registrations.
7.1. The prices displayed on the Site are indicated in euros, all taxes included. The total amount due is indicated on the Registration confirmation page and on the subsequent Registration confirmation email.
Prices include supervision of children, insurance (the risk of damage to glasses is not covered, however), equipment, premises and any transport depending on the activity chosen.
7.2. In the event of non-payment of the amounts due by the due date specified in the confirmation email, these will initially be increased by a flat rate of €10 for reminder fees, after which the
Amounts due on the due date will also be increased automatically and without prior formal notice by late payment interest of 1% per month as well as a fixed compensation set at 10% of the principal amount due as a penalty clause, with a minimum of 25 euros, without prejudice to any recovery costs which will also be borne by the Client. Compensation of the same order is provided for Actionsport if the latter does not fulfill its obligations.
7.3. In the event of non-payment on time, a free reminder email will be sent to you. In the event of persistent non-payment, the file will be forwarded to the VENTURIS collection agency. The latter will then take over and automatically apply a fixed penalty of 20 euros as well as late payment interest at the key rate increased by 8 points until full payment. A similar penalty may be charged, as a reciprocal measure, in the event of failure to meet our obligations.
7.4. In the event of Registration during the year, the cost of the Contribution to be paid to Actionsport corresponds to the pro rata of the Courses still to take place until the end of the period of the selected Extracurricular Activity.
8.1. Actionsport cannot be held liable, generally speaking, in any case where the non-performance or poor performance of its obligations results from a case of force majeure or fortuitous event beyond its control.
8.2. The User acknowledges that their use of the Site is at their own risk. The Site is provided to them "as is." Actionsport will make its best efforts to make the Site accessible 24 hours a day, seven days a week, except in the event of an event beyond the control of Actionsport and subject to maintenance periods, possible breakdowns, technical hazards linked to the nature of the network or malicious acts or any damage to Actionsport's hardware or software.
Actionsport cannot be held liable under any circumstances for any interruption of all or part of the Site, regardless of the cause, duration or frequency of this interruption, provided that this interruption is not attributable to it.
8.3. Actionsport is not bound by any obligation of results and cannot be held responsible for omissions, inaccuracies or errors in the programs included on its site, nor for the consequences that these could have for Customers.
8.4. Actionsport cannot be held liable under any circumstances for any error, omission or inaccuracy mentioned during the Courses or in the documents provided to Clients as part of them.
8.5. Actionsport does not guarantee that the Courses offered correspond to the needs of the Client, who is solely responsible for his choice.
8.6. Actionsport is not responsible for loss, theft or breakage of items brought to the Courses by participants.
8.7. If Actionsport's liability is established, it will be limited to an amount equal to the amount of the Subscription price without any compensation for other indirect losses of a financial, commercial or other nature, such as loss of earnings, loss of reputation, savings or expected customers.
9.1. Actionsport grants the Client a period of 14 (fourteen) calendar days to withdraw from the Registration, without having to provide a reason, starting from the day of Registration. After this period, no withdrawal request will be processed by Actionsport, subject to the provisions of Article 9.2.
The Customer who exercises his right of withdrawal must complete the withdrawal form annexed to Book VI of the Code of Economic Law, available at the following URL

He may also inform Actionsport of his decision to withdraw by sending an unambiguous declaration expressing his wish to withdraw by email to the address [email protected].
In the event of exercising the right of withdrawal, Actionsport will reimburse the Client for all sums paid, if applicable, without undue delay and at the latest within 14 (fourteen) calendar days from the date on which it is informed of the Client's wish to withdraw. If one or more Courses have been provided to the participant during the withdrawal period, Actionsport will withhold the Fee from the payment or, failing payment, will be entitled to claim from the Client the portion of the Courses provided between the start of the execution of the contract until the Client informs Actionsport of his wish to withdraw, with regard to the totality of the Courses initially planned.
The refund will be made by crediting the amount debited to the account corresponding to the Customer's bank card.
9.2. After the withdrawal period of 14 (fourteen) calendar days from the date of registration, Actionsport gives the Client the option to cancel the Registration free of charge, provided that the written cancellation request has been received by Actionsport no later than 24 hours before the start of the Courses. In this case, Actionsport will reimburse the Client for the amounts paid, without any deduction of fees.
In the event of withdrawal more than 14 (fourteen) calendar days from the date of registration but occurring less than 24 hours before the start of the Course, Actionsport will reimburse the Client for the sums paid less the sum of 15 euros, retained in payment of the administrative costs borne by Actionsport, which the client accepts.
9.3. In the event of interruption by the Client of the Course provided by Action Sport for which he/she has registered, the full amount of the contribution remains due/acquired to Action Sport unless the Client produces a medical certificate justifying his/her inability to continue the Course. The Client acknowledges and accepts that the failure to obtain a Covid Safe Ticket, whether voluntary or not, cannot constitute the medical reason allowing the Client to obtain reimbursement of all or part of the Contribution or exemption from payment of all or part of it.
9.4. In the event of a Trial referred to in Article 6.4, and provided that the Client has informed Actionsport of his wish to no longer continue the Courses at the end of the Trial, Actionsport will reimburse the Client for the entire Fee that he has paid, where applicable.
9.5. In the event of a prolonged illness of at least three consecutive weeks of the child, the Client may obtain a refund for the Courses in which the child was unable to participate less the sum of 15 euros, retained as payment of the administrative costs incurred by Actionsport, provided that the Client produces a medical certificate confirming the reality of the prolonged illness and that prior to the courses in which the child did not participate, the Client has informed Actionsport of the child's absence due to illness.
In the event of exercising the right of cancellation, Actionsport will reimburse the Client for the sums due where applicable, without undue delay and at the latest within 14 (fourteen) calendar days from the date of the last day of absence.
10.1. The lack of sufficient registrations for an Extracurricular Activity as well as the impediment of an instructor, constitute for Actionsport cases of force majeure which allow Actionsport to change instructor without obligation to inform the Client in advance to cancel the Extracurricular Activity on the site without having to demonstrate the unpredictability and irresistibility of the circumstances or the impossibility for Actionsport to fulfill its obligations. These events being external to Actionsport, it cannot be held responsible.
10.2. In the event of cancellation of an Extracurricular Activity on the site, the Client will have the option of opting for the same Extracurricular Activity on another site or for another Extracurricular Activity at the same time depending on existing availability. If no alternative Extracurricular Activity proposal is suitable for the Client, the Client will be fully reimbursed for the amounts already paid to Actionsport.
10.3. In the event of a change in the dates of an Extracurricular Activity, the Client has the right to cancel his registration and obtain a refund of the Fee provided that this request is brought to the attention of Actionsport in writing within 14 working days following the date on which the change of date was notified to the Client.
If the Client does not respond within this period, their registration will be considered confirmed for the new dates.
10.4. Without prejudice to the special regimes to be adopted by the competent authorities, the threat of the Covid-19 virus and the taking of measures against it as well as the threat of other epidemics and the taking of measures against them, as well as all acts of government, strikes, lockouts, riots, mobilization, bad weather, shortages of equipment or means of transport, fires, etc., are automatically considered, for the purposes hereof, as constituting a case of force majeure justifying the cancellation of one or more Courses without Actionsport having to demonstrate the unforeseeability, the irresistibility of the circumstances and the impossibility of fulfilling its obligations. The same applies to the cancellation of one or more Courses due to usual symptoms of the Covid-19 virus detected in the participant. As these events are external to Actionsport, it cannot be held responsible. If such events constituting cases of force majeure occur, Actionsport is not subject to the obligation to reimburse all or part of the price of the Subscription that the Customer has paid and the Customer is not exempt from paying all or part of the price of the Subscription, if the latter has not yet made its payment.
11.1. Actionsport and the Client reserve the right to terminate the contractual relationship at any time in the event of non-compliance by the other party with any of its obligations under these T&Cs, without prejudice to any possible damages that may be claimed from the defaulting party.
11.2. The termination of contractual relations in the event of fault on the part of the Client results in the immediate payment of the remaining amounts due.
11.3. Actionsport reserves the right to terminate the lessons of a child whose behavior constitutes an obstacle to the smooth running of the lessons of other children.
12.1. The Client must provide appropriate sportswear for the Extracurricular Activity. Equipment specifications are detailed in the Registration Confirmation. The Client must ensure that jewelry/watches or other objects likely to cause injury or breakage are removed before the start of the Courses.
12.2. In the event of inclement weather, outdoor activities may continue. The Client must provide appropriate clothing for their child, as well as a possible change of clothes.
12.3. Signed authorization from the parent(s) is required if the child returns alone or with a third person at the end of the course days.
13.1. The User undertakes to comply with the laws in force when using the Site and in particular not to make discriminatory, racist, xenophobic, anti-Semitic remarks, nor insults, abuse or other violent or pornographic remarks, nor to publish content contrary to public order or morality.
The User is also prohibited from using the Site for promotional purposes.
The User undertakes not to attempt to harm the operation of the Site or Actionsport.
13.2. Actionsport cannot be held responsible for any incompatibility, malfunction or other technical problems between the use of the Site and the User's computer equipment, except in the event of a fault attributable to Actionsport.
The User must protect his computer equipment against any risk of contamination by viruses, attempted intrusion, etc.
13.3. When creating their MyActionsport Account online on the Site, the User undertakes to provide true, accurate, up-to-date and complete information about their identity.
14.1. The Site, all elements found on the Site and the documents provided to Clients as part of the Courses are protected by intellectual property rights (including in particular all copyright, rights to patents, trademarks, designs and models, databases, domain names and any other existing or future intellectual property rights, Belgian and international) and belong to Actionsport or to third parties having authorized it to use them.
The use of the Site or the documents provided to Clients as part of the Courses does not confer any intellectual property rights on the Client.
14.2. Any reproduction or representation, in whole or in part, of the Actionsport website or of the documents provided to Clients as part of the Courses without the prior written consent of
Actionsport constitutes a violation of the intellectual property rights of the latter and/or third party licensors and may result in civil and criminal proceedings.
15.1. Actionsport ensures respect for customer privacy and data. It undertakes to ensure that the information collected is processed in accordance with applicable laws and regulations.
When using the Site, Users may be required to provide a certain amount of personal data about themselves (surname, first name, telephone number, email address, etc.).
The personal data provided is particularly necessary for access to registration forms, their validation and payment, for the management and monitoring of registrations by Actionsport and to respond to Customer requests as well as to facilitate their identification and navigation on the site and for statistical purposes. The data may also be used to carry out operations relating to prospecting.
Access to personal data is strictly limited to Actionsport staff authorized to process it due to their duties.
The Client is informed that in the event of a legal or judicial obligation requiring it to do so, Actionsport may be required to transmit its personal data.
The data collected when registering for an Extracurricular Activity is kept until its deletion, which is left to the initiative of the Client unless:
In accordance with applicable legal and regulatory provisions, the Client has the right to access, rectify, transfer, and erase their data, as well as to limit processing. They may also, for legitimate reasons, object to the processing of their data.
He may thus demand that his personal data that is inaccurate, incomplete, ambiguous or outdated be rectified, completed, clarified, updated or deleted. The Client's personal data is also deleted when the Client expressly withdraws his consent to the collection and processing of his personal data, subject to Actionsport's legal obligations. The Client may also, under the right to the portability of his personal data, retrieve his personal data for his personal use, or request that it be transferred to a third party, if this is technically possible.

To exercise these rights, the Client must send a written request to Actionsport stating their first and last name. Actionsport may ask the Client to prove their identity by attaching any necessary documents to their request, including a copy of their identity card or passport.
Customers also have a right to lodge a complaint, which they can exercise with the national supervisory authority, namely the Data Protection Authority.
Actionsport will implement the means at its disposal to process requests relating to Customers' personal data as quickly as possible.
In the event of a security breach or loss of personal data relating to Customers, Actionsport will inform them by email in accordance with applicable legal conditions. It will take all necessary measures, within the limits of its human, material, and financial resources, to remedy the breach and ensure data security.
15.2. Data may also be collected through cookies.
In fact, during each of the User's visits to the Site, Actionsport collects information relating to their connection and navigation.
Cookies are an automatic tracking process that records information relating to navigation on the Site, and stores information entered during visits to the Site in order to facilitate the registration procedure and use of the Site.
The User can oppose their installation and/or delete them following the procedure indicated on their browser.
A cookie has a limited validity period of thirteen (13) months maximum. Its deposit and storage on the User's terminal are carried out in compliance with applicable laws and regulations and subject to the choices expressed by the User, which he can modify at any time.
Cookies have several functions, such as facilitating the use of the Site, remembering the User's choices, the goods and services he wishes to purchase, and offering the User relevant advertising content.
Actionsport collects the User's express consent to the use of cookies.
The cookies placed by Actionsport give it access to information enabling it to establish User browsing statistics.
Photos taken during the Courses are considered free to use by Actionsport for its communication tools: websites, social networks, etc.
The use of these images has no other purpose than to illustrate the projects and activities of Actionsport. However, the Client has the opportunity to oppose this use.
Actionsport invites the Client who has made this choice to inform the instructors, from the first lesson, so that the photos of his child are not published on any media.
17.1. No modification of these T&Cs may be made unless it is negotiated, authorized and signed by a duly authorized representative of Actionsport and unless this modification contains the express mention that it consists of an adaptation of these T&Cs.
17.2. If one or more provisions of these General Terms and Conditions are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope. Actionsport and the Client shall, however, undertake to negotiate and conclude one or more provisions intended to cover the nullity found.
17.3. The fact that one of the Parties does not assert against the other Party a breach of any of the obligations referred to in the General Terms and Conditions of Sale cannot be interpreted in the future as a waiver of the obligation in question or a waiver of asserting this failure or breach.
17.4. The fact that one of the Parties does not avail itself of a stipulation of these General Terms and Conditions of Sale does not in any way constitute a waiver of the benefit of said stipulation.
18.1. The rights and obligations resulting from these General Terms and Conditions are exclusively subject to Belgian law.
18.2In the event of a dispute relating to a registration, the Client must first contact Actionsport in order to find an amicable solution.
In the absence of an amicable solution and whatever the origin of the conflict, disputes relating to the execution or interpretation of these General Terms and Conditions will be submitted to the courts of the judicial district
of Walloon Brabant or to the competent Court pursuant to Article 624, 1°, 2° and 4° of the Judicial Code if the Client is a consumer within the meaning of the Code of Economic Law.
For all practical purposes, it is specified that the time limits for taking legal action are not interrupted during the period in which an amicable solution is sought or mediation is requested.
